The legal status of the tracks

Unlike most other tracks in the area, the legal status of these green lanes (U5001 and U5004) has never been established. As UUCRs - Unclassified Unsealed Country Roads - they can lawfully be used by motor vehicles, although they were clearly not made for this type of traffic.

​

In 2006 all green lanes listed on the 'Definitive Map' as footpaths, bridleways or restricted byways in England and Wales were closed to motor vehicles, But because these UUCRs are on the council's 'List of Streets' and not on the definitive map, this exclusion does not apply to them.

​

The NERC Act had the - unintended - consequence of opening up these tracks to recreational motor vehicles.

​

But there is a legal instrument that National Park Authorities should use in this kind of situation: a Traffic Regulation Order.
